These terms and conditions of use (the "Terms") govern access to and use of the eker.luxe website and the eKer mobile apps (the "Platform"). By creating an account or using the Platform, you accept these Terms.

1. Publisher

The Platform is published by TonuxCorp, NINEA 006921010, RCCM SN DKR 2018 A 18865, Dakar, Senegal. Contact: contact@eker.luxe, +221 77 099 98 26.

2. Purpose of the Platform

eKer is a real estate matchmaking platform. It lets users publish and browse properties for sale and rent, real estate projects and agent profiles, and communicate with each other.

eKer is not a seller, landlord, real estate agent or notary. eKer is not a party to transactions between users, does not receive any funds related to the sale or rental of a property, and does not verify property titles.

3. User account

You must be at least 18 years old and provide accurate, up-to-date information.
You are responsible for keeping your credentials confidential and for any activity under your account.
One account per person; it is personal and non-transferable.
You can delete your account at any time from your profile.

4. Publishing listings

By publishing a listing, you guarantee that:

you own the property or hold a written mandate to offer it;
the property exists, is available, and the information (price in FCFA, area, location, photos, declared legal status) is accurate and up to date;
you hold the rights to the photos, videos and texts published;
you comply with applicable regulations, including rental rules (caps on deposits and fees).

The following are prohibited: fake, misleading or duplicate listings, properties you are not entitled to offer, requests for payment before a visit, unlawful, offensive or discriminatory content, and any attempted fraud. eKer may moderate, refuse, suspend or delete a listing or account that breaks these rules, without notice in case of serious breach.

5. Agents and verified badge

Professionals may request a "verified agent" badge. This badge indicates that certain identification details were checked by eKer at the time of verification. It is neither a guarantee of the quality of the agent's services nor of the properties they offer.

6. Packages and payments

Some features (publishing beyond a quota, featured listings, projects…) require a paid package. The content, duration and price of each package are shown on the Packages page, in FCFA, including any applicable taxes.
Payments are processed by our providers: Bictorys (Wave, Orange Money), Stripe (card) and PayPal. Their own terms apply.
A package is activated as soon as the provider confirms the payment.
An activated package is non-refundable, except in case of double payment, a technical error attributable to eKer, or where the law requires it. Send any request to contact@eker.luxe with the transaction reference.
A package cannot be transferred to another account.

7. Transactions between users

Exchanges, visits, negotiations and contracts are concluded directly between users, under their sole responsibility. We strongly recommend that you:

visit the property before any commitment;
have the legal status checked by a notary and obtain a recent statement of real rights from the DGID;
use a notary for any sale, and sign a written lease for any rental;
never pay in cash without a receipt, or send money before a visit.

8. Liability

eKer makes every effort to ensure access to and proper operation of the Platform, but cannot guarantee continuous availability. Listings are published under the responsibility of their authors: eKer does not guarantee their accuracy, nor the solvency, identity or good faith of users. To the extent permitted by law, eKer is not liable for disputes between users, nor for losses resulting from a transaction concluded following a listing. Articles and tools (including the loan calculator) are provided for information only and do not replace professional advice.

9. Reporting

If you see a suspicious listing or abusive behavior, use the report feature or write to contact@eker.luxe. We review every report.

10. Intellectual property

The eKer brand, logo, design and editorial content of the Platform belong to TonuxCorp. Any reproduction without permission is prohibited. By publishing content, you grant eKer a free, non-exclusive license to display, reproduce and promote it on the Platform and its communication channels for as long as it is published.

11. Personal data

The processing of your data is described in our privacy policy.

12. Changes to the Terms

eKer may change these Terms. The applicable version is the one online when you use the Platform. For significant changes, you will be informed on the Platform.

13. Governing law and disputes

These Terms are governed by Senegalese law. In case of dispute, the parties will first seek an amicable solution by writing to contact@eker.luxe. Failing that, the competent courts of Dakar will have jurisdiction.
