This policy explains how eKer collects, uses and protects your personal data when you use the eker.luxe website and the eKer mobile apps (together, the "Platform"). It applies in accordance with Senegalese law No. 2008-12 of January 25, 2008 on the protection of personal data and its implementing regulations.

1. Data controller

2. Data we collect

Data you provide

Account: name, email address, phone number, profile photo, address, password (stored encrypted) or Google or Apple sign-in identifier.
Listings and projects: descriptions, photos, videos, documents, prices, location and legal status of the properties you publish.
Communications: messages sent through the chat, visit requests, reports and messages to support.
Agent verification: information and documents provided to obtain the verified badge.
Payments: selected package, amount, payment method, mobile money number and transaction references. We do not store card numbers: they are processed directly by our payment providers.

Data collected automatically

Usage: pages and listings viewed, favorites, searches, alerts, preferences and interests.
Device: device type, operating system, browser, IP address, language and push notification identifier.
Location: if you allow it, your approximate position to show nearby properties. You can withdraw this permission at any time in your device settings.
Cookies and local storage: needed for sign-in, your language choice and for the site to work properly.

3. Why we use your data

Create and manage your account, and authenticate you (including by SMS code);
Publish, display and promote listings;
Connect users, owners and agents;
Process package payments and keep our accounts;
Send you notifications (messages, alerts, updates on your listings);
Keep the Platform secure and prevent fraud and abusive listings;
Improve our services and measure their use;
Comply with our legal obligations and respond to requests from competent authorities.

Depending on the case, this processing is based on the performance of our terms of use, your consent, our legal obligations or our legitimate interest in securing and improving the Platform.

4. Information visible to other users

When you publish a listing, its details together with your name, profile photo and the contact details you choose to display are visible to visitors. Do not publish information you do not want to make public.

5. Recipients and service providers

Your data is intended for the eKer team. We do not sell your data. We use service providers that process it on our behalf, only for the needs of the service:

Hosting of the Platform's servers and files;
Google Firebase: authentication (including SMS codes) and push notifications;
Google Maps: maps and address search;
Payments: Bictorys (Wave, Orange Money), Stripe (card) and PayPal;
Google Gemini (artificial intelligence): your natural-language searches and property characteristics are sent to it for smart search and to help write descriptions. Your account contact details are not sent to it.

Some of these providers are located outside Senegal. These transfers are governed in accordance with law No. 2008-12 and limited to what the service requires.

6. Retention

Account and listings: as long as your account is active, then deleted or anonymized once it is deleted, subject to the periods below;
Messages: for the life of the account;
Transactions and invoices: for the period required by accounting and tax obligations;
Technical and security logs: for a limited period needed to secure the Platform.

7. Security

We apply appropriate technical and organizational measures: encrypted connections (HTTPS), encrypted passwords, restricted data access, keys and secrets kept out of the code. As no system is infallible, choose a strong password and never share your sign-in codes.

8. Your rights

Under law No. 2008-12, you have the right to information, access, rectification, deletion and, on legitimate grounds, to object to the processing of your data. You can:

edit your information from your profile;
delete your account from the app or the website;
turn off notifications and location in your device settings;
exercise your rights by writing to contact@eker.luxe, with proof of identity.

If you believe your rights are not respected, you can contact Senegal's personal data protection authority (Commission de protection des Données Personnelles, CDP): www.cdp.sn.

9. Minors

The Platform is intended for people aged 18 or over. We do not knowingly collect data about minors.

10. Changes

We may update this policy. The last update date appears at the top of the page. For significant changes, we will inform you on the Platform.
